3 years from arrest to court appearance for Death by Dangerous driving

    This one has been on my mind since the day of the incident – I’ve cycled through this exact spot many, many times.

    The allegation was that a driver was rashly overtaking another driver, possibly a racing rival, in this narrow country lane right on the edge of the town of Ilkley. He hit a cyclist, Adrian Stocks, who died at the scene.

    The driver was arrested within hours, but only three years later has he appeared in court. He has pleaded guilty to causing death by dangerous driving.

    The mind boggles as to why this case took three years to get to court. I still think about Mr Stocks and this incident every time I pass the road on my bike, wondering what has happened to justice in this case. I can only think of the pain that these delays had for his family.

    I can only hope a very, very lengthy driving ban ensues.

    I was looking forward to something more coming from your close pass case, like some humiliating press coverage for the police for trying to pursue this case or at least some disparaging remarks from the judge. It seems they got away with it by letting the case quietly disappear. It was an attempt at bullying and at the very least a massive waste of police time and resources to try to prosecute you for this so they should face repercussions.

    One of my friends had to wait several years for a crown court trial against him. The charges were thrown out when his defence counsel discovered that the prosecution had failed to disclose key evidence in his favour.
    He suffered extreme stress during this time, with the fear that he may end up in prison.
    Having a long interval between the offence or alleged offence and the trial is not a perk to the accused.

    I look forward to June 22nd when the sentencing will take place. Hopefully it will appear in Road.cc’s roundup for June.

    I’ve cycled through this exact spot many, many times

    I have also cycled these exact roads twice in both directions recently travelling from Garstang to my daughter’s house in Leeds. Do we assume the killer has been driving around unrestricted for the last three years?
