    Running this one up the flagpole to see who salutes… 

    I just don’t remember this being a thing until recently, now it seems a daily occurrence.
    Could it be that there are drivers not up to the job, too many cars; should houses be made to ride in single file, shops put on high viz, why are we putting newer buildings in danger like this, it’s irresponsible.

    “It is reported that the vehicle was also in collision with a pedestrian, but they did not require medical treatment.” ‘

    Supposedly it joined from the Station if the person at the station saw it go past. Satellite view shows what looks like the allotments almost a mile further down the track (including just past a bridge the photo above was probably taken from).

    At the risk of being controversal, they were all “adults” from the pictures and either were drinking with him or should have been aware he was drunk and / or driving atrociously. Apparently they had been sending snap chat footage from within the car (used to identify where they had been in the car) just before the smash. I doubt the footage would have been them screaming at him to slow down. 

    So whilst his driving was awful, and probably would have been unlawful if it was children in the car, I suspect that the coroner was also looking at them choosing to be in the car as well and probably cheering him on.

    Although stating all that, on his actual legal comments, you do have to wonder what “truly exceptionally bad” driving is if the crash above is not counted in his mind.

    • natural causes (including fatal medical conditions);
    • accident or misadventure;
    • industrial disease;
    • dependence on drugs/non-dependent abuse of drugs;
    • attempted/self-induced abortion;
    • disasters subject to public inquiry;
    • lawful killing (such as deaths caused during acts of war, or self-defence);
    • unlawful killing;
    • suicide;
    • open verdict (where there is insufficient evidence for any other verdict).

    The commencement of the provisions in the Coroners and Justice Act 2009 have added some further possible conclusions to this list:

    alcohol/drug related death, and
    road traffic collision.

    The conclusion of unlawful killing is restricted to the criminal offences of murder, manslaughter (including corporate manslaughter), and infanticide. Cases where driving causes death may, therefore, only be regarded as unlawful killing for inquest purposes if they satisfy the ingredients for manslaughter (gross negligence manslaughter) or where a vehicle is used as a weapon of assault and deliberately driven at a person who dies (murder or manslaughter depending on the intent).” (my emphasis)

    It strikes me that the test for manslaughter is met and that Unlawful Killing would therefore be the right coroner’s verdict. The article doesn’t say what the conclusion actually was – misadventure, I’m wondering? But none of this will bring any of them back.

    A drunk driver near

    A drunk driver near Shrewsbury crashed into a house at 1.50am on Monday morning. He also caused a power cut as he also took out an electricity pole. 49 homes were without power for up to 9 hours.
