Disgraceful failure to prosecute under-take and close pass – west Yorkshire

    So, here is video of what I thought was a cut and dry road traffic offense. As I was riding to work at about 30mph in a 30mph zone (because I was going downhill, not because I’m MvdP), I was being tailgated by this driver. I then signal and move right to go round the parked cars. This driver then cuts up the INSIDE of me, driving very close to me, and then has to slam on the brakes to avoid hitting the car in front

    I uploaded the file to the portal for West Yorkshire police within a few hours, providing all the necessary details. They are declining to prosecute, apparently because this doesn’t meet the necessary criteria for being considered as a crime.

    This is an absolute disgrace. What exactly do you have to do in West Yorkshire to be considered as a dangerous driver? I wonder if the failure to prosecute is related to my previous run-ins with WYP?

    I had a bad accident 28Aug cycling  along minding business, nothing in front of me, next thing I know, I’m laid on the road, with multiple injuries  (no breaks luckily) ambulance and police. I never knew what hit me. Got knocked unconscious! Helmet on the front wrecked.  It was a van, which totally wiped me out. I’m battered but lucky to be alive. The wife has banned me from riding ever again. Both wheels, left hand crank and pedal bent. Bar tape destroyed and handle bars twisted. I have quite a few sets of wheels and spares to sort it out. Titanium is tough thank goodness. I’m going to rebuild it and give it to my grandson to sell. He’s only 15 but a wheeler dealer already. When I’ve healed I’m joining the local gym. I used to train in the gym for many years as well as the bike. Van driver said I hit him, which is ridiculous. The police believed him and his mate as a witness.
    Never think it’s going to happen but it does! Cyclists are 3rd party citizens. Glasses & Apple Watch wrecked. 
    The wife always asked me when I come back from a ride.  ‘anyone try to kill ya’
    My ankle is the worst very badly sprained. I’m done with bikes at 74

    I beg you all, please stay as safe as you can, although anything coming from behind, you can do nothing about! as I’ve found out

    Interesting – assuming it’s sarcastic. I spoke to Bill Earlie last year and had an email exchange with him over a non-cycling incident in Scotland. He seemed to be communicative and helpful, despite ultimately rejecting my complaint (on the grounds that Police Scotland should have dealt with it; but PS refused to deal with it on the grounds that my home force (West Yorks Police) should deal with it; after my MP got involved, PS reluctantly conceded that Earlie was right; but too late – it was conveniently Out of Time.)
    Earlie did say that if W Yorks Police had dealt with it, the truck driver concerned would have been charged with careless driving. From what you say, he might not have been so helpful had I been on my bike. It was non-cycling, but here’s the footage for anyone interested: https://youtu.be/dZ3aplJUUuU .

    Efficiency. With just one PCC commissioning both the police and the crime, crime and arrest rates can be set to keep the public afraid but still passive. Or something like that.

    PCCs are expensive worthless
    PCCs are expensive worthless junk and should be binned – which is just what they do with any letters sent to them in their capacity as the second tier of complaints against the police. When the inevitable response is, essentially, that’s what the police have decided so it must be correct, the value of a load of people sitting around in County Hall should be obvious

    Ah – so it’s an important position that we all have to fund but once in they’re then careful to spell out they actually can’t do any more than you or me, typing comments into the void.

    Stop me if you think you’ve heard this one before…

    Sounds like the PCC system was a truly excellent political invention!  There’s a new way to reward loyalists (perhaps via their relatives/friends) at taxpayer’s expense and possibly even trial folks for higher office.  They can absorb all those irritating whinges from a powerless public.  And since they’ve no powers there’s zero risk they’ll seriously stuff something up (e.g. actually cause the police any bother)!

    I predict that the response from the PCC will be: this is an operational decision of the police – we can’t be involved, in practice, if not in exactly those words. That was the invariable response of the (disappointingly, both Tory and Labour incarnations
