Reporting to your Police Force

    Essex have changed their policy. You used to have 48 hours to submit and it had to be at the high end of the offence (or words to that effect). Then you got a reply that nothing/something/NIP was going to happen.

     

    Now they have 10 days as a policy and 2 minutes either side but I got this back

    “Footage showing instances of a more serious nature can result in offering the offender an educational course, a fixed penalty notice or preparing a file to be heard at court. Footage which is deemed as evidence of an offence but of a less serious nature can be dealt with by being held as intelligence by us. This intelligence can be used to show a trend of poor driving behaviour for use in future prosecutions.

     

    Due to the high number of offences reported to us, we are regrettably unable to enter into any discussion with regards to the outcome of your submission of footage to us.”

     

    So basically I will have no idea if what I send in is suitable and I am wasting their time as it wil be NFA. (I have queried this by email, but not hopeful of a reply)

     

    What do other readers experience in their area ?

     

    What file types and size do you send off?

    My file was 561 MB as it was 1080p HD. I had to take a laptop to work to upload it !

    My experience with the Met is that they won’t proactively update you on the outcome, but will provide an update in response to a request. Agree it’s good to have feedback, as it takes a while to upload 2 x 4 mins of HD footage and I’d rather know whether to bother next time.

    Thanks Laura, I’m aware of that from your article plus other sources, however 6-7 reports with no reponses does make me wonder if I’m submitting them badly or “making a mountain out of a molehill” of the incidents. If they are not worthy, I’m wasting both mine and their time really. 

    Maybe a follow up article on whether they are going to keep up the good work now they seem to have been folded into the greater WMP Traffic umbrella rather then their own one?

     It is the second time the team have been changed in a few months. It might be because of the serious illness of one of the team or that the “funds” have been redirected but I’m worried about OpsClosePass and others that helped us and put WMP at the forefront of cycle safety originally.

    I spoke to West Midlands Police about this when I wrote this article with tips on how to provide good camera evidence. They don’t contact everyone who submits evidence so they can spend more time dealing with incidents which, with limited resources makes sense, even if it’s not what would happen in an ideal world.

    We need that for WMP. I have not heard anything from any of the submissions I have made for the last few months and they state they will only contact if prosecuted. I’m wondering if an FOI or SAR is required to get this info. The last one submitted was an attempted push at 25mph so I’m particularly interested on that one although it is the one with the least cam evidence as I only have one go-pro on the handlebars at the moment.

    Same here with South Wales

    Same here with South Wales Police.

     

    You are given a reference number when you submit footage or a report online through the GoSafe website, and are then told that due to the volume of cases they have to deal with that you will not be given any future updates, unless you are summonsed to court as a witness. Despite this you are still required to retain the footage of the incident in its original form on the device on which it was recorded! So I now have a couple of ‘spare’ memory cards sat here with recent footage on them, and a few more video files sat on my PC waiting to go back on a card if ever the case is taken further. Of course I have absolutely no idea how long that might take!

    I actually heard back to be told there is a new trial where you put in the reference and see the decision.
    This will be a simple status and no details of why will be available.

    I submitted a close pass a couple of weeks ago and the process seemed the same, but I’m still waiting on a response. Maybe they’re too busy?

    I also don’t see how GDPR comes into play when they aren’t identifying an individual.

    Not entirely convinced about gdpr. There is no direct connection between the vehicle and the driver at the time; no personal details have been identified or shared.
    The email back does not mention any gdpr constraints.

    If your matter was reported and recorded as a crime (crime number needed not a log No) as a victim, you are actually covered by the victims charter which states that you are entitled to recive regular updates by the OIC of your case and they must inform you of any decisions made to the case of final decisions, such as – NFA, Driver Improvement scheme, Court case.

    If you do not receive these updates after your matter has been crimed – you can contact the Police force and demand an update and if not happy with that – you can speak to the Dept of the Police Commissioner for that force and make a complaint.

    A&S responses are very poor now. In the past when you upload/report an incident you get a reference number then usually a week later a follow up email saying we are going to send a NIP letter to the owner/driver as the drivng fell below an acceptable standard.

    Now you get an email for uploading footage and that’s it, no further detaIl of what action is being taken against the driver of the vehicle involved because  giving out updates to witness would not be operating in accordance with the GDPR and DPA guidance.

    Avon & Somerset’s portal

    Avon & Somerset’s portal gives you a reference and then usually a week or two later you get a response from them. If I remember correctly, they ask if the incident was with the last 7 days and they want 2 minutes before and after. I usually upload front and rear 1080p footage and file sizes are similar to yours.

    I think it’s really useful to get feedback – it’s typically either sending the driver a letter, or NIP, or they can disagree with the incident being an offense that they wish to pursue.
