The inquiry heard that Mr MacIntyre did not use the nearby cycle track because it had traffic-calming bumps and a 20mph speed limit, which he would have often broken, said his wife.

So that answers my question about whether he was on the road or the cycle track. The witness in the car behind McTaggart also says he was on the road.

I also found [url=http://www.lochaber-news.co.uk/news/fullstory.php/aid/2629/Bike_path_ignored_by_bikers.html]reports of complaints from local drivers[/url] who were fed up with cyclists on the A82 during the Fort William MTB World Cup. They couldn’t understand why they weren’t using the “£2 million bike path built specially for them”. Maybe because it is too slow and inconvenient? It may have cost a lot of money, but that doesn’t mean it is well designed.

Thanks, I’ve been following this, and drove past the location whilst on holiday 2 years ago. I still don’t understand where the driver hit the cyclist. Jason could have been on the road or an off road cycle path next to it, but no account of the accident I’ve read makes clear exactly how the bike and van collided. Caroline MacIntyre says that the police examined the wrong part of the road.
