Pot Hole Damage

Hi All,

Just a quick question,

Has anyone ever made a claim for pot holes damaging expensive wheels?

If so, how do you go about putting a claim in?

Yes I have made a successful claim; but through the British Cycling Federation (now British Cycling). It was a pain in the arse just providing the evidence to make the claim. The council made various claims, riding without due care and attention, too close together and they filled it in before we could photograph it! (it was under water when we hit it). As above the council have a duty to take reasonable care to maintain and inspect the road; not ensure it is always pothole free. This claim is the reason I am still a member! If the pot hole has been reported (CTC's 'Fill that Hole' for example) it could be relatively straight forward; so report potholes!!! Sorry to be wise after the event but would recomend to all cyclists to be members of either BC or the CTC for legal assistance in situations such as this. Without legal assistance it could be financially risky but check your home insurance, it may give you legal assistance or speak to legal firms who may take it on no win no fee.

it's written for motorists but the legal duty of the council and the due process are exactly the same for cycling

basically you have to prove that the council didn't inspect and repair the highways in accordance with the national code
